On December 19, 2024, Law 2439 of 2024 was enacted. Its objective is to partially amend Law 1480 of 2011 (“Consumer Statute”) to strengthen consumer protection in the realm of e-commerce. This amendment aims to establish clear measures regarding the exercise of the right of withdrawal and information, among other prerogatives that safeguard consumers' rights in digital environments, promoting greater transparency and security in transactions carried out through electronic platforms.

Among the main provisions of this regulation is the update of the legal framework in favor of consumers in digital environments, ensuring that legal provisions are adapted to the new realities of e-commerce. These include, namely:

Main amendments and objectives of the Consumer Statute

• Strengthen consumer protection in e-commerce transactions. In particular, it is established that, in cases of exercising the right of withdrawal, the refund to the consumer must be made within fifteen (15) calendar days, provided that the conditions for providing complete information to process the refund are met, as well as the proper return of the product.

  This term applies not only to the producer and/or supplier but also to financial entities and any other parties involved in the process.

• Require providers to deliver clear, sufficient, and up-to-date information about the products or services offered. The law also reinforces the obligation of providers to offer clear, reliable, and sufficient information regarding the products or services offered, enabling consumers to make informed decisions.
• Furthermore, it mandates that providers must guarantee accessible customer service channels that allow users to file and track their requests, complaints, or claims, thereby fostering a more agile and reliable relationship between the parties.
• Additionally, the legal definition of a contact portal is added as "Any electronic platform provided by individuals or legal entities that connects suppliers or producers with consumers, through which the consumer and the producer or supplier can directly establish a consumer relationship".
• Additional measures are established regarding the protection of transactions carried out through financing systems via electronic means.
• Finally, the Superintendence of Industry and Commerce (“SIC”) is granted expanded powers to oversee and mandate measures to prevent harm to consumers in the context of electronic commerce. These powers are intended to ensure effective compliance with regulations and to protect users’ rights against potential breaches.

Law 2439 of 2024 emerges as a response to the growing importance of e-commerce in the national economy and the need to provide a safer and more reliable environment for consumers. This legislative effort aims to balance technological innovation with the protection of users' fundamental rights, promoting a transparent and fair digital ecosystem.
